The starting point

Before buying a property for holiday rentals in Spain, establish the regional tourism requirements, local planning position, community rules and whether the business can lawfully continue after ownership changes. An Airbnb listing, tourism registration or the seller’s income record does not establish all four. Community approval requirements changed in April 2025, while 2026 judgments altered the national rental registration procedure. Where the investment depends on tourist income, obtain property-specific evidence and agree what happens if the necessary conditions cannot be satisfied before paying a binding deposit. The right solution may be an approved operation, a different investment price or another property.

1. Start with the business you actually intend to buy

A property might be used as your own home, a conventional residential letting, accommodation for a genuinely temporary need or tourist accommodation. The building may be identical, but the documentation, running costs and relationship with occupants differ. Before relying on an advertised return, describe your plan: guest numbers, usual length of stay, advertising channels, operating months, services provided and the weeks you will reserve for your own family. That description makes enquiries to authorities and advisers considerably more useful.

A practical review has four layers: the physical and planning legality of the property; permission for the particular tourist activity; the community position where horizontal ownership applies; and the requirements for operating the business. A positive answer in one layer does not settle the others. A house may have an occupation document yet remain unsuitable for the proposed tourist use. An activity may appear in a tourism register while a relevant community restriction was never examined when its declaration was filed.

Ask for a purchase report that reaches a conclusion about your particular plan. “Documents reviewed” does little to establish who may operate, how many guests may stay, for how long, which actions remain outstanding and what happens on a subsequent sale. The conclusion should also identify matters that depend on an administrative decision that has yet to be obtained. Those uncertainties belong in your investment decision and purchase timetable.

2. An advertisement and an income figure need supporting evidence

“Tourist licence included” can describe very different situations. The seller might produce a current registration, a filing receipt, a number associated with a management company or an authorisation covering a different layout or guest capacity. Obtain the complete document and compare its address, cadastral reference, holder, capacity, category and dates with the property you are buying. Verify authenticity through the appropriate official verification system and examine the underlying file where necessary. A cropped screenshot cannot reveal operating conditions or later enforcement action.

Request the original declarations, amendments, inspections, information requests, sanctions and any cessation or suspension decisions. Ask about pending proceedings even where there is no final penalty. If the seller authorises an administrative enquiry, specify the records to be obtained and who will obtain them. An unanswered question must remain an outstanding check; it cannot reasonably become a positive statement that the property has no problems.

To investigate income, use summaries that reconcile bookings, receipts, refunds and commissions without collecting unnecessary guest information. Separate occupied nights from available nights and gross receipts from profit. A property let occasionally by its owner provides a different evidence base from a full-time operation. Preserve relevant marketing representations: they will help establish which business characteristics have actually become part of your bargain, rather than disappearing into a general assumption about future demand.

3. Community approval, building rules and pre-existing activity

For tourist activity falling within article 5.e of the Urban Leases Act, article 7.3 of the Horizontal Property Act has required prior express community approval for those intending to start it since 3 April 2025. Article 17.12 requires the favourable votes of three fifths of all owners representing three fifths of ownership shares for decisions approving, limiting, conditioning or prohibiting that activity. Paying community charges on time or receiving a friendly response from the administrator does not amount to that approval.

Obtain the constituting deed, statutes, relevant resolutions and a certificate identifying the particular property and the scope of the decision. Where material, a lawyer should review voting calculations, ownership shares, notification and possible challenges. Operating conditions, conduct rules and validly imposed additional charges also matter. If a restriction appears ambiguous, investigating its meaning before committing to purchase is considerably easier than handling a dispute after guests have begun arriving.

The second additional provision addresses continuity for owners already carrying on the activity before the reform who had previously complied with tourism legislation. That requires evidence of dates and activity, rather than simply an earlier purchase or an intention to let. Where the property is being sold now, examine continuity under the incoming owner expressly. The buyer should not automatically be credited with every transitional protection asserted by the seller, especially where the proposed operating arrangements are changing.

4. Local planning answers questions a tourism register does not settle

A municipal enquiry should identify the exact plot, dwelling and proposed activity. Establish the land classification, permitted use, any heritage protection and the conditions for introducing tourist accommodation. The floor, independent access, building type or concentration of accommodation in a particular area may matter. Also investigate suspensions affecting new applications, planning changes and proceedings relevant to the particular file. An answer obtained several years ago may describe a materially different position.

Where an urban compatibility report, licence or another enabling document is required, obtain the applicable document and all its conditions. A responsible declaration places responsibility on the applicant for satisfying what is declared; it is not a complete and final administrative review. Plans, bedrooms, authorised capacity and physical reality should correspond. Converting a garage into another guest bedroom can introduce a planning problem even where the original tourism registration was properly obtained.

In Madrid city, for example, the review must incorporate the planning rules amended by Plan RESIDE and their application to the building, proposed establishment and administrative history. Rules for the capital should not be extrapolated to the entire Madrid region. The useful question is whether this particular dwelling, with this access and this administrative position, accommodates your intended use. A general report about a municipality will rarely provide enough detail for an investment decision.

5. Andalusia, Murcia and Valencia: which records to request

In the Valencian Community, use the current official registration and amendment procedure to establish what is required when the operator or property owner changes. Those are different events and should be described accurately. Examine the registration, its validity, renewal requirements and the relevant municipal report. The framework includes validity periods and transitional situations, making the accommodation’s dates and history important. A marketing statement describing a “lifetime licence” should not become an untested assumption in your valuation.

In Andalusia, Decree 31/2024 develops requirements for tourist dwellings and provides for justified municipal restrictions. Investigate the measures actually adopted locally and identify the operating entity. Registration in the Andalusian Tourism Register still needs to be consistent with planning and community requirements. In the Region of Murcia, the official procedure for registration, closure and amendments identifies documents and notifications associated with tourism classification; local conditions also require examination.

These examples explain how to organise an investigation, rather than suggesting equivalent rules across regions. Two properties offered at the same price may need very different administrative records, and a regional response does not replace a municipal one. Ask your adviser for a simple matrix showing the competent authority, document, date, named holder and consequence of the proposed transfer. For every missing item, identify who will obtain it and whether its contents could change the purchase decision or financing assumptions.

6. The Balearics: accommodation places, category and transfer need attention

In the Balearics, acquiring the property and obtaining the ability to market tourist stays must be examined together without assuming they are the same transaction. The island, designated area, dwelling type, operating category, accommodation places and duration of existing authorisations matter. The documents should establish whether the relevant places form part of the bargain and under what restrictions. An offer combining a property price with an assumed tourist return needs a verifiable explanation of that connection.

The tourism containment measures introduced by Decree Law 4/2025 include a prohibition on creating new tourist accommodation places in multi-family residential buildings. Buying any apartment with the intention of applying for tourist status afterwards may therefore fail at the outset. An existing operation requires investigation of its own enabling documents and the continuity or renewal rules that actually apply. Enquiries also need to involve the competent island council and relevant planning rules, rather than transferring an answer about Mallorca to Menorca, Ibiza or Formentera.

Ask the purchase contract to identify what is being transferred: ownership, furniture, rights or enabling documents connected with the activity and any commercial commitments being assumed. If a management company is involved, compare its representations with the official file. The review needs to establish what you will receive, rather than merely describing what the seller was permitted to do at an earlier point in time.

7. National rental registration: what changed in 2026

As at September 2026, an explanation based entirely on the changes introduced in 2025 can be misleading. The consolidated text of Royal Decree 1312/2024 incorporates judicial annulments affecting the Single Rental Registration procedure and the mechanism for obtaining a number through registration. The Supreme Court judgment of 19 May 2026, published in the official gazette on 8 June, annulled the affected provisions while leaving the remainder subject to the terms of its decision. The current text and relevant subsequent decisions need to be consulted.

This creates three separate questions: which legal obligations currently apply to the activity; which regional identification exists; and what the advertising platform requires. A national number previously obtained did not, by itself, establish full planning or tourism permission. Equally, annulment of the national procedure does not remove regional legislation, municipal restrictions or community requirements. It should not be presented as blanket permission to advertise any property.

Before engaging a marketing manager, request a dated and documented explanation of the requirements it will apply. If a platform retains an older form or requests an identifier, clarify the basis and correct process without inventing numbers. Keep the correspondence and avoid making completion depend on a platform screen that still does not establish whether the proposed operation is legally viable. Administrative and commercial interfaces can lag behind a legal change, which is precisely why the underlying evidence matters.

Legal framework and sources: BOE · Real Decreto 1312/2024, texto consolidado con anulaciones de 2026 ↗BOE · Sentencia del Tribunal Supremo de 19 de mayo de 2026, publicada el 8 de junio ↗

8. The change of ownership is a separate due diligence question

Ask expressly what changes on the completion date. The property owner may change, the operator may change, both may change, or the same contracted company may continue managing the business. Identify the person named in every document and the notification, declaration, authorisation or renewal required. Receiving the seller’s platform login does not answer those questions. The continuity of bookings and the continuity of administrative permission are related matters that each need their own answer.

Build a chronology covering the original enabling document, evidenced commencement of activity, legislative changes, community decisions, amendments and next renewal date. That sequence helps establish whether a transitional regime is being invoked correctly. If the dwelling has been inactive, changed capacity or undergone alterations, investigate the consequences. Not every event extinguishes an authorisation, but none should be ignored merely because it complicates the sale.

The agreement should require delivery of the complete file and the seller’s cooperation with the steps for which the seller is responsible. Establish what happens if an authority requires a fresh assessment that prevents your project. If continuity cannot be established before purchase, assess the transaction with that risk expressly acknowledged. A clause saying that “the buyer will complete the necessary formalities” can transfer a far larger uncertainty than the administrative cost of filing a form. It deserves the same attention as a proposed change in the purchase price.

9. The investment model should survive a cautious scenario

Calculate income using the months and guest capacity you can lawfully operate. Then deduct commissions, management, cleaning costs not passed on to guests, utilities, insurance, community charges, maintenance, replacement costs and applicable taxes. Separate recurring expenses from initial investment and distinguish the property’s return before financing from cash available after debt payments. If the seller highlights exceptional summer receipts, request quieter months as well and explain the assumptions used to project a complete year.

Tax treatment depends on residence, ownership, services and the actual activity. A non-resident may have rental income obligations alongside obligations relating to periods when the property is available for personal use, depending on the circumstances. Obtain an individual calculation rather than copying percentages from another owner. A purchase-cost calculator estimates acquisition costs; a tourist operation requires its own operating budget and tax analysis.

Prepare at least one scenario with lower occupancy and another based on an alternative permitted use. Conventional residential letting is not an identical substitute: it changes your availability, the occupant’s rights and cash flow. If the purchase only works with an uncertain permission and high occupancy, the contingency is fundamental. A modest discount or token retention is unlikely to compensate for years of income that cannot be earned. Quantifying that exposure before negotiations helps distinguish an affordable administrative delay from a business model that simply does not work.

10. Deposit and purchase agreements: make viability objectively verifiable

If you have not signed, explain in writing that tourist use is decisive to your purchase. Negotiate a period for investigation with access to documents and, where appropriate, a condition tied to objective outcomes: evidenced planning compatibility, sufficient community approval and a documented ability to continue or commence the activity. The drafting should identify the documents, relevant authority, deadline and treatment of money paid if the answer is unfavourable or arrives too late.

Avoid provisions that merely require someone to “apply for the licence”. Filing an application can satisfy that wording even if the eventual decision prevents the intended business. Distinguish refusal from the seller’s failure to cooperate and regulate extensions clearly. The professional drafting the deposit agreement should coordinate the condition with finance, vacant possession and the nature of the deposit. No universal clause guarantees recovery of every payment under every Spanish purchase contract.

If you have already signed, preserve advertising, messages and documents and seek advice before allowing deadlines to expire or announcing unilaterally that you will not complete. Available options depend on the agreement, incorporated representations, your knowledge and the significance of the promised use. A negotiated retention may secure identifiable outstanding costs when properly structured; it does not create a missing authorisation or compel an owners’ community or public authority to grant one. That distinction should guide both the amount retained and the decision whether to proceed at all.

Hypothetical example

11. Worked example: attractive advertised income, unresolved permission

Fictional example using illustrative figures only. A couple considers an apartment priced at €280,000. The listing describes €32,000 in annual holiday rental income and says a licence is included. The file contains a tourism registration in the seller’s name, but lacks the documents needed to assess continuity after sale. The community certificate confirms that charges are paid; it does not establish approval to start the activity or explain whether an earlier operation enjoys relevant transitional protection.

The couple prepares a budget. From the hypothetical €32,000 gross income they deduct €6,400 for management and marketing, €4,500 for utilities and recurring expenses, and €2,000 for maintenance and replacement. That leaves €19,100 before financing, personal taxes and other excluded costs. If revenue falls to €24,000 while the commission remains 20% and the other assumed expenses stay constant, the equivalent balance is €12,700. These calculations illustrate sensitivity rather than forecasting the rental market or every cost of operating the property.

Their lawyer proposes obtaining the missing community, municipal and transfer documents first. Alternatively, they could negotiate an objectively verifiable purchase condition with a reasonable deadline, or value the apartment solely against a permitted residential use. If the seller insists on an immediate commitment without clarifying continuity, the couple may conclude that there is insufficient evidence to justify a tourist-operation price. The investigation has identified an investment issue before it becomes a dispute after completion.

12. Before guests arrive: contracts, bookings and responsibilities

A viable purchase still needs an organised handover. Where future bookings exist, establish who received advance payments, who owes the accommodation service and which cancellation or amendment terms apply. Do not assume commercial commitments you have not seen. The management agreement should address duration, exclusivity, commissions, information access, money handling and termination. Buying the real estate does not automatically transfer platform accounts, reviews or contractual relationships into your name.

Prepare a calendar of applicable obligations: administrative notifications, accommodation standards, incident handling, traveller documentation where required, data protection, invoicing and taxation. Allocate every function expressly and request confirmation of performance. A manager arranging cleaning may not handle your personal tax returns, while a tax adviser may not investigate continuing planning compatibility. Maintain insurance appropriate to the actual use and the technical measures required for the operation, with responsibility for renewal clearly assigned.

The review should leave an updateable file containing property identification, dated sources, permissions, community decisions, enquiries, unresolved issues and your conclusions. Spain Property Check can help organise property information and identify matters requiring investigation. Tourist-use viability, particularly where it depends on local decisions or continuity after a transfer, requires those checks to be completed with the relevant documents and professionals. Only then can the operating model be assessed on a documented basis rather than treating projected income as assured revenue.

Frequently asked questions

Can I use Airbnb because other neighbours already do?

Other neighbours’ activity does not establish that your property satisfies the same conditions. They may have different histories, prior approval or a different configuration, or may themselves be non-compliant. Investigate your tourism file, planning position and community requirements. Request documents identifying your particular dwelling and activity. The absence of complaints does not replace required approval or guarantee that enforcement will never occur.

Does a tourist licence automatically transfer with the property?

Do not assume so. Identify the enabling document, regional framework, named holder and specific consequence of changing owner or operator. Notifications, declarations, checks or renewal may be relevant, with conditions affecting continuity. The community position requires a separate assessment as well. Before paying a price that includes value for an operating business, obtain a documented explanation of what you will receive and which steps remain outstanding.

Does an eleven-month contract avoid tourist rental rules?

The label and duration do not determine a letting’s nature by themselves. Its real purpose, the occupant’s needs, marketing and other circumstances matter. A genuine temporary stay needs appropriate justification and documentation; a short contract can still meet a permanent housing need. Renaming a contract without changing the underlying reality is not a reliable solution. Establish the correct category and its consequences before using a standard template.

Did the 2026 judgments remove all tourist letting permissions?

No. The annulments affect the national procedure in the provisions of Royal Decree 1312/2024 covered by the judgments. They do not remove regional tourism legislation, municipal planning or horizontal ownership rules. Consult the current framework and the activity’s and platform’s actual requirements. An older number does not by itself establish that planning, community approval and the ownership change have been addressed.

What if I paid a deposit and discover that holiday letting is unavailable?

Collect the contract, annexes, advertising, messages and activity documents and seek advice before the next deadline. The review must establish whether tourist use was a condition, a contractual representation or an expectation that was never agreed, and identify the actual obstacle. Refunds are not automatic in every case. Obtaining an official answer, negotiating an amendment or assessing contractual remedies may be necessary depending on the facts and evidence.
