Getting started
Can I buy in Spain without being resident?
Generally, yes. The buyer's identity, legal capacity, funding and tax obligations must be checked. Some acquisitions and locations have special requirements, so confirm nationality, purchasing structure and the particular plot before committing funds. Buying does not itself grant immigration residence.
Sources and scope: Spanish Civil Code · Organic Law 1/2025
Link to this answerDoes having an NIE make me tax resident?
No. An NIE identifies a foreign individual; tax residence follows tax rules and, where applicable, the treaty between countries. Nationality, immigration permission, municipal registration and tax residence are different concepts. Tell your adviser where you live and how your personal and economic circumstances are distributed.
Sources and scope: Non-Resident Income Tax Act
Link to this answerDoes buying a property give me a golden visa?
A purchase does not automatically grant residence. Spain ended the route for new investor authorisations under Law 14/2013 from 3 April 2025, with transitional provisions for certain applications. Any alternative immigration route and earlier cases need separate assessment.

Link to this answerWhat should I decide before viewing properties?
Decide the use: living there, occasional stays, residential, temporary or holiday letting. Add your total budget, funding, renovation plans and ownership horizon. An appealing home may not permit the intended use. This brief should guide both your search and the documents checked before reservation.

Link to this answerShould I buy alone, jointly or through a company?
The choice affects shares, matrimonial rules, finance, tax, succession and a future sale. No structure is universally best. Establish who supplies the money and who acquires each share. A company also requires checks on representation, beneficial ownership and ongoing compliance costs.

Link to this answerShould my budget be limited to the advertised price?
No. Separate the price, taxes, notary, registry, advice, borrowing and renovation. Then add annual costs and a contingency for items not yet quoted. Our calculator keeps unknown items visible: a blank field does not mean zero cost or inclusion in somebody else's fee.

Link to this answerHow can I compare two investments without guessing returns?
Use explicit assumptions for occupancy, rent, costs, borrowing and tax, then test cautious and adverse scenarios. First establish that the proposed letting use is legally feasible. Distinguish gross yield, net yield and cash flow. A sales forecast does not establish future income or replace property evidence.

Link to this answerIs there one advisory fee for every Spanish purchase?
There is no universal published fee for full advice. Colás Abogados quotes according to the property, documents, issues and agreed scope, with competitive fees defined before engagement. The document generator's price relates to that product and does not itself include an individual purchase review.
Sources and scope: Scope of the firm’s service
Link to this answerDoes nationality alone determine the tax?
No. Transaction type, location, tax year, tax residence and the taxpayer's circumstances matter. A foreign owner's nationality and tax residence may differ. Do not automatically use a tax treatment or reduction obtained by another buyer simply because you share a passport nationality.

Link to this answerWhat information helps obtain a legal quote?
Provide the municipality, approximate price, intended use, funding, timetable and whether a reservation or contract already exists. Supply the available registry and property documents through the channel agreed with the firm. There is no need to publish documents or send full banking details through open forms.

Must my lawyer have an office beside the property?
Proximity is not the only criterion. Property experience, independence, knowledge of the applicable rules and access to official documents matter. Many legal checks can be coordinated remotely. Where visits, measurements or specialist technical work are needed, the appropriate professional is involved at the property.
Sources and scope: Scope of the firm’s service
Link to this answerWhere does Colás Abogados provide in-person advice?
The office is in El Albir, L’Alfàs del Pi, Alicante. The firm offers in-person advice in the Valencian Community and Murcia and remote advice for purchases throughout Spain. The specific arrangements, travel and involvement of other professionals are defined in the engagement quote.

Link to this answerCan I buy without travelling to Spain?
A purchase can be organised through properly documented representation. Before choosing that route, confirm the power's wording, form, language and authentication with the notary handling completion. Electronic signature of a private agreement does not automatically replace the authority required for the public deed.
Sources and scope: Spanish Civil Code
Link to this answerWhat authority should a purchase power contain?
It should match the actual assignment: acquisition, payments, taxes, registration and, where relevant, mortgage borrowing. Substitution and multiple-representation situations should be expressly addressed when relevant. Broad authority should not be granted without understanding its scope and limits.
Sources and scope: Spanish Civil Code
Link to this answerDoes a foreign power need an apostille and translation?
This depends on the country, document and execution route. An apostille authenticates the document's origin under the applicable convention; it does not guarantee sufficient authority for the Spanish purchase. Equivalence, translation and acceptance should be confirmed before execution and dispatch.
Sources and scope: Spanish Civil Code
Link to this answerCan I sign a deposit agreement through DocuSign?
The generator allows DocuSign signing, document review and confirmed dispatch to the supplied addresses. Each signer receives an invitation; after completion the agreement and certificate can be retrieved. Identity, authority and terms must be correctly established; the platform does not determine them by itself.
Sources and scope: Scope of the firm’s service · Spanish Civil Code
Link to this answerDoes DocuSign replace the public purchase deed?
Do not confuse signing the private agreement with executing the public deed, registration and mortgage formalities. Each stage has a different role. Arrange execution personally or through an authorised representative with the notary, and retain the private agreement and its signing evidence too.
Sources and scope: Spanish Civil Code
Link to this answerWho translates the contract's free-text descriptions?
The form separates Spanish and English entries for text requiring bilingual wording. Both versions must be completed and reviewed; a Spanish copy is not presented as an English translation. Names, addresses and identifiers remain literal references. Complex technical wording may need specialist translation.
Sources and scope: Scope of the firm’s service
Link to this answerWhat should I check before transferring money?
Independently confirm the recipient, account holder, purpose, amount and refund terms. An emailed change of bank details deserves additional verification. The contract should explain who holds the funds and when they may release them; retain proof of the transfer.
Sources and scope: Spanish Civil Code
Link to this answerHow is a remote purchase coordinated?
A contact person and document timetable are agreed, records and certificates requested, findings checked with the seller and technical professionals, and a legal report delivered before the contract. Terms, signing and agreed follow-up are then coordinated. Distance does not remove the need for evidence or necessary site work.

Link to this answerDocuments, planning and title
What does a Nota Simple show?
It gives information about the registered property, ownership, rights and charges at the time of issue. Read it with the seller's title and other documents. It is neither a building inspection nor a planning certificate, and it does not replace the updated registry checks required before completion.
Sources and scope: Land and Urban Rehabilitation Act · Spanish Civil Code
Link to this answerAre the Cadastre and Land Registry the same?
No. They serve different purposes and may describe areas or buildings differently. Match the registered property, cadastral reference, plans and physical reality. Paying local property tax or seeing a building in the Cadastre does not itself prove planning legality or resolve an ownership discrepancy.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerWhat should I do if the floor areas differ?
First distinguish usable, built, plot and common-element areas. Identify each figure's source and obtain a survey where needed. Then decide whether clarification, cadastral or registry correction, or building regularisation is required. The agreement should record the agreed solution, responsible party, cost and timetable.
Sources and scope: Land and Urban Rehabilitation Act · Spanish Civil Code
Link to this answerDoes a pool in the Cadastre have planning approval?
Cadastral recording is not enough. Check the permit or authorisation, construction date, land classification, restrictions and proceedings. Age or appearance in an aerial photograph does not establish an unrestricted right to retain or use the structure. Seek a conclusion supported by specific documents.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerCan I buy with an extension awaiting registration?
Establish whether regularisation is possible and exactly what is missing. The parties may require registration before completion and agree milestones, costs and consequences of non-performance. A retention does not make a building lawful or guarantee registration. Avoid assuming everything can be resolved afterwards.
Sources and scope: Land and Urban Rehabilitation Act · Spanish Civil Code
Link to this answerWhat is a planning certificate?
It is information from the competent authority about planning status within its stated scope. Relevant issues include classification, permitted uses, development parameters and restrictions. Names and content vary. Check its actual statements, date, plot and limitations; applying for one is not obtaining a favourable answer.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerDoes a no-infringement certificate guarantee the entire property?
Not necessarily. It may cover only known proceedings or a particular period and authority. Check whether it covers the building and the outcome required by the agreement. Insufficient scope needs permits, reports and enquiries to supplement it; no recorded proceedings is not always full planning compliance.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerWhat should I check for a coastal property?
Relate the plot to the public coastal-domain boundary and applicable easements. Check concessions, permissions, proceedings and restrictions affecting proposed works or use. Apparent distance from the beach and an advertisement describing private ownership do not replace documentary coastal-law checks.
Sources and scope: Coastal Act
Link to this answerHow should flood exposure be checked?
Combine official mapping, planning information, plot data and, where needed, a technical report. Distinguish probability levels, use restrictions, safety and insurability. A map is a screening tool, not a substitute for a technical conclusion on the home or a required administrative response.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerDo I need an architect as well as a lawyer?
Depending on the property, yes. A lawyer examines rights, documents, obligations and contractual protection; a qualified technical professional performs the commissioned inspections, measurements and technical assessments. Coordinating both addresses documentary and physical discrepancies without treating a legal report as a structural survey.

Link to this answerReservation, deposit and contract
Are a reservation and an arras agreement the same?
The heading does not determine the legal effect. Read the obligations, conditions, deadlines, payment destination and consequences of withdrawing. A reservation can create important commitments. Before paying, establish whether the money is refundable, in which circumstances and who must return it.
Sources and scope: Spanish Civil Code
Link to this answerDo arras always let me withdraw by losing the deposit?
Not every deposit is a withdrawal deposit. Its nature depends on the agreement and applicable law. Distinguish agreed withdrawal, breach and termination under a specific condition. Do not assume any transfer buys a right to walk away or that every breach automatically requires double repayment.
Sources and scope: Spanish Civil Code
Link to this answerMust the deposit always be 10%?
It is a common reference point, not a universally compulsory percentage. The parties agree the amount, timing and consequences. The generator allows a different amount. Also check the holder, proof of payment, release conditions and refund mechanism before committing.
Sources and scope: Spanish Civil Code · Scope of the firm’s service
Link to this answerCan I make the purchase conditional on a mortgage?
An express condition can define minimum funding, deadline, required applications, diligence and evidence of a bank decision or lack of response. Coordinate it with completion and the deposit terms. Without such an agreement, do not assume failure to obtain finance entitles you to a refund.
Sources and scope: Spanish Civil Code
Link to this answerHow should a bank's failure to respond be addressed?
The agreement can expressly cover it, requiring a complete application, buyer cooperation, a reminder to the bank and evidence that no decision arrived by the deadline. It should specify the termination notice and timing. Not every delay should automatically count as refusal without verifiable conditions.
Sources and scope: Spanish Civil Code
Link to this answerWhat happens if the seller has a mortgage?
Arrange both repayment and removal from the register: these are separate steps. An updated bank certificate establishes the debt; discharge and administration costs also need budgeting. The agreement and deed should identify who pays the lender, what is retained and how registered discharge is evidenced.
Sources and scope: Spanish Civil Code
Link to this answerHow is an attachment managed before buying?
Identify the creditor, proceedings, registry entry and updated amount including ancillary sums. Agree evidenced discharge or a workable payment and retention mechanism supported by documents. The seller's consent alone does not release an attachment. Retentions and actions must match the specific proceedings.
Sources and scope: Spanish Civil Code
Link to this answerWhere should price retentions be specified?
In the agreement, once known and agreed, specifying the item, amount or justified formula, holder, purpose and release conditions. Coordinate them with completion payments. An arbitrary amount may be insufficient; holding money does not replace documents or registration required before completion.
Sources and scope: Spanish Civil Code
Link to this answerCan I require documents before completion?
Yes, through clauses defining the document, issuing body, required outcome, deadline and consequences. A certificate should be favourable within the necessary scope, not merely exist. Address incomplete or adverse responses and when the transaction may proceed, be postponed or terminate under the agreement.
Sources and scope: Spanish Civil Code · Land and Urban Rehabilitation Act
Link to this answerDoes the generator automatically include every clause?
It adds modules according to the answers and information supplied; it should not insert a mortgage, attachment or undeclared building that does not exist. Review the complete agreement before signing. The tool does not verify the truth of the answers or turn an out-of-scope case into an individually reviewed purchase.

What should I request from the owners' association?
Request a debt certificate, rules, budget and latest meeting minutes; obtain earlier minutes if works, litigation or relevant decisions arise. Review fees, special levies, use restrictions and common areas. The certificate and minutes answer different questions and should be assessed against the proposed completion date.
Sources and scope: Horizontal Property Act
Link to this answerDoes a clear debt certificate exclude future special levies?
No. Approved or planned works may have instalments that are not yet due. Read the latest and relevant earlier minutes and ask for budgets and timing. The purchase agreement should expressly allocate obligations, distinguishing overdue debt from future special-levy instalments.
Sources and scope: Horizontal Property Act
Link to this answerWho pays special levies when a home is sold?
Distinguish liability to the association from the agreement between buyer and seller, and consider the type of charge and due date. Approval date alone is not enough. Record each party's obligations and completion adjustments in writing using current supporting documents.
Sources and scope: Horizontal Property Act · Spanish Civil Code
Link to this answerCan the property be affected by earlier community debts?
The property may be legally affected by earlier owners' debts within the applicable statutory period. Do not rely solely on the seller's assurance. Obtain an updated certificate, investigate debts and levies, and document payment or retention. Some autonomous communities have their own civil-law rules to consider.
Sources and scope: Horizontal Property Act
Link to this answerCan I enclose a terrace or alter the façade?
Review the title, common elements, rules and resolutions, as well as the applicable municipal permit or control procedure. One neighbour's permission is not the required association approval. Nor does association approval replace planning permission when that is required.
Sources and scope: Horizontal Property Act · Land and Urban Rehabilitation Act
Link to this answerIs a terrace for private use necessarily privately owned?
Not always. It may be a common element allocated for exclusive use, with restrictions on works, maintenance and access. Check the deed, association title, plans and rules. Advertising the area or access from only one home does not itself establish its legal status.
Sources and scope: Horizontal Property Act · Spanish Civil Code
Link to this answerHow should a garage or storage unit be checked?
Establish whether it has its own registered title, is inseparable from the dwelling, is a co-ownership share with allocated use or merely a usage permission. Check number, plan, access and charges. The contract must identify the acquired right; a remote control or key does not prove transferable ownership.
Sources and scope: Spanish Civil Code · Horizontal Property Act
Link to this answerShould I request an energy certificate?
Check that one exists when required, is valid, matches the property and meets the applicable registration and delivery requirements. It is different from an occupancy permit, structural survey or planning-compliance evidence. Any claimed exemption needs justification and should not be assumed merely because a building is old.
Sources and scope: Energy performance certification — RD 390/2021
Link to this answerIs the occupancy document called the same thing everywhere?
No. Depending on the territory, building and circumstances, it may be a licence, habitability certificate, responsible declaration or another document. Establish which applies, its validity and suitability for the intended use and utilities. An application or electricity bill does not automatically replace required occupancy evidence.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerWhat should I check about utilities?
Check contracts, account holder, payment position, supply type and whether transfer or reconnection is possible. Rural homes also require enquiries about water, drainage and easements. Existing electricity or water does not prove the property's overall legality; confirm the transfer process with documents and suppliers.
Sources and scope: Land and Urban Rehabilitation Act
Link to this answerPurchase taxes and costs
Will I pay transfer tax or VAT when buying?
It depends on the transaction and territory. A resale subject to TPO generally attracts transfer tax; a developer's first supply may attract VAT and stamp duty. The Canary Islands and Ceuta/Melilla have special rules. Building age or this being your first purchase is not decisive alone.
Sources and scope: Ministry of Finance — regional taxes 2026
Link to this answerIs purchase tax always calculated on the price?
Not necessarily. Identify the relevant tax base, declared value and, where applicable, reference value or assessment rules. A low price does not guarantee a low tax base. Also separate the taxes: VAT, transfer-tax and stamp-duty bases should not be treated as interchangeable.
Sources and scope: Ministry of Finance — regional taxes 2026
Link to this answerIs cadastral value the same as reference value?
They are different concepts. Cadastral value is relevant to local property tax and some imputed-income calculations; reference value may matter for transfers and inheritance. Confirm the document, date and tax. Entering the wrong value into a calculator can produce a precise-looking but incorrect estimate.
Sources and scope: Ministry of Finance — regional taxes 2026 · Non-Resident Income Tax Act
Link to this answerDoes the purchase calculator cover all Spain?
It includes every autonomous community, Ceuta and Melilla, with separate foral territories. It calculates the treatments identified on screen and leaves unconfirmed information pending. It does not automate every personal relief or transaction type. Check territory, date, base and eligibility before relying on an estimate.

Link to this answerWhat changes when buying in the Canary Islands?
Alongside local property and planning rules, the islands have a separate indirect-tax regime: a first supply may attract IGIC instead of VAT. Check stamp duty, exemptions and applicable rates. Special relief is not automatic simply because the home is on an island or the buyer is non-resident.

Link to this answerWhat changes in Navarre and the Basque Country?
There are foral tax administrations and rules, and separate cadastral systems. In the Basque Country distinguish Álava, Bizkaia and Gipuzkoa. Do not automatically borrow a neighbouring province's rate or apply an AEAT instruction without checking jurisdiction. Location and connecting rules determine the relevant authority and treatment.

Link to this answerCan I claim a reduced rate because of age or family status?
Only if every condition of the relief applicable to the place and date is met. These may concern main-home use, value, income, assets, deadlines and evidence. Meeting one condition is not enough. Retain supporting records and check subsequent obligations that could trigger repayment of the relief.

Link to this answerWho pays notary and registry fees?
Separate the purchase deed, mortgage and discharge of existing charges: they are different operations. Review the rule and agreement for each cost. Link to this answerDoes being foreign automatically mean a tax surcharge?
Do not assume a general surcharge for foreign nationality. Check current law, tax residence, buyer type and the particular acquisition. A political proposal or news report is not an enacted, applicable tax. Distinguish announcements, publication, commencement and the transactions actually covered.

Link to this answerMight I need to report the property in my home country?
There may be income, asset, capital-gain or reporting obligations. Treatment depends on that country, the treaty and your circumstances. Coordinate Spanish advice with residence-country advice and retain certificates and payment evidence. Paying Spanish tax does not automatically remove every obligation elsewhere.

Link to this answerOwnership and Modelo 210
Do I have Spanish obligations if I live abroad all year?
Living outside Spain does not remove obligations associated with the property. Separate municipal property tax, local charges, community costs, rental income, imputed income for private use and, where relevant, wealth taxes. Build a calendar by owner, use and tax year. Modelo 210 does not replace municipal taxes or all other returns.
Sources and scope: Non-Resident Income Tax Act · AEAT — Modelo 210 instructions
Link to this answerWhat is Modelo 210?
It is a Non-Resident Income Tax self-assessment for certain income obtained without a permanent establishment. A property owner may need it for letting, private use or a disposal gain, under different rules. The property alone is insufficient: the taxpayer, tax residence, period, income and applicable treaty matter.

Link to this answerIs a second home taxable even if I do not rent it out?
Imputed property income may arise for days covered by that regime. Relevant cadastral figures, ownership, period and the applicable statutory percentage are used, followed by the taxpayer's tax rate. Do not confuse this calculated income with rent received or municipal property tax. Exceptions and specific circumstances require checking.
Sources and scope: Non-Resident Income Tax Act · AEAT — Modelo 210 instructions
Link to this answerWhen is imputed income for 2025 and 2026 reported?
AEAT distinguishes the tax years: 2025 imputed income is reported during 2026; 2026 imputed income between 1 April and 31 December 2027. Direct debit has its own cutoff. Identify the income year first: the year in which you submit the form is not necessarily the year it covers.

Link to this answerIs annually grouped 2026 rental income due in January 2027?
For annually grouped 2026 rental income with tax payable, the new window is 1–20 April 2027 under AEAT's transition note. Do not apply that date indiscriminately to separately reported income, refunds or disposals. Check grouping requirements and payment method before relying on a calendar.

Link to this answerWhat happens to separately reported rental income during 2026?
The transition distinguishes income accrued in the first three quarters of 2026, which retains the previous deadlines, from fourth-quarter income under the new rule. For example, third-quarter tax-payable returns are filed on 1–20 October 2026; fourth-quarter returns on 1–20 April 2027.

Link to this answerDoes a married couple file one Modelo 210 per property?
Do not assume a joint return simply because the owners are married. Identify each taxpayer, ownership percentage and attributable income under the form's instructions. Keep these consistent with the deed and ownership changes. Grouping income does not turn several owners into one taxpayer.

Link to this answerWhich documents should I prepare for annual tax compliance?
Prepare the deed, cadastral reference and figures, IBI bill, identification, tax-residence certificate where relevant, ownership percentage and use calendar. For letting, add income, agreements, invoices and expense evidence. Retain previous returns. An organised file helps identify duplicated days or amounts and assess deductions without assuming every expense is deductible.

Link to this answerDoes the calculator file my taxes?
No. An estimate helps prepare figures and questions; it does not submit a return to the authorities or independently establish the applicable regime. Can any home be rented to tourists?
Check permitted use, regional and municipal rules, planning status, community restrictions and required registrations. A home suitable for permanent residence does not automatically have tourist-letting permission. Define the operating model before buying and request property-specific evidence rather than a general statement that rentals are allowed in the area.
Sources and scope: National rental register — RD 1312/2024 · Horizontal Property Act · Land and Urban Rehabilitation Act
Link to this answerDoes the national registration number replace tourist permission?
It should not be treated as a general licence. The national rental register and platform requirements coexist with applicable regional, municipal and civil requirements. Check the category, enabling permission and validity for that accommodation. Publishing an advertisement or obtaining a number does not itself cure an incompatible planning use.
Sources and scope: National rental register — RD 1312/2024 · Land and Urban Rehabilitation Act
Link to this answerCan the owners' association affect tourist letting?
Review the legal regime, bylaws, resolutions and commencement dates. The national Horizontal Property Act provides for specific tourist-letting resolutions and since 2025 includes prior-approval requirements in the cases covered, with transitional provisions. Do not automatically apply the rule to an existing activity or territories with their own civil-law regime.

Link to this answerDoes a rental licence transfer with the purchase?
That depends on the permission, category, territory and particular conditions. Notification, a holder change or new authorisation may be required. Obtain the file, not just an advertising screenshot. Sources and scope: National rental register — RD 1312/2024 · Land and Urban Rehabilitation Act · Spanish Civil Code
Link to this answerAre seasonal and tourist rentals the same?
Not necessarily. Actual purpose, marketing method, services and territorial rules help determine the regime. A contract label or a term of a few months does not settle classification by itself. Sources and scope: Urban Tenancies Act · National rental register — RD 1312/2024
Link to this answerCan I combine personal use and letting?
This may be possible if the property's regime permits the intended letting. For tax purposes, keep a verifiable calendar of rented days and other uses alongside income and expenses. Link to this answerDoes buying a tenanted home allow me to remove the tenant?
A sale does not justify assuming the tenancy disappears. Review the agreement, dates, term, extensions, registration, payments and any pre-emption rights. If vacant possession is essential, it must be agreed and evidenced through a legally workable arrangement. Do not rely solely on a promise that the occupier will leave.

Link to this answerWhat should I check about deposits and unpaid rent?
Request a documented schedule of rent, deposit, additional guarantees, adjustments and disputes. What is the 3% withholding when a non-resident sells?
For transfers subject to this obligation, the buyer withholds and pays 3% of the consideration attributable to the non-resident seller as a payment on account of that seller's tax. It is not necessarily the final capital-gains tax. Tax residence needs documentary verification and withholding must be coordinated with completion payments.
Sources and scope: Non-Resident Income Tax Act · AEAT — Modelo 210 instructions
Link to this answerAre Modelo 211 and Modelo 210 the same process?
No. The buyer uses Modelo 211 for the withholding where required. The seller reports disposal income through Modelo 210, taking the payment on account into consideration and seeking a refund if appropriate. Giving the seller the receipt supports reconciliation; it neither replaces their return nor establishes that no gain arose.

Link to this answerIs municipal plusvalía the tax on the overall sale gain?
They are different obligations. Municipal plusvalía concerns increases in urban land value under its rules; non-resident or resident income tax assesses income or gains separately. The liable party, absence of increase and applicable calculation method require separate consideration. Do not derive municipal tax solely from the home's total sale price.

Link to this answerDoes a repaid mortgage disappear from the Land Registry?
Economic repayment and registry discharge are separate steps. Obtain a debt statement, discharge documentation and later registry evidence. Link to this answerHow can co-owners sell while living in different countries?
Confirm owners, shares, capacity and required consents. If powers of attorney are used, review authority, form, authenticity and suitability for the intended act before arranging completion. Link to this answerWhich acquisition and improvement records should I keep?
Keep deeds, tax payments, regulated fees, professional invoices and records of work on the property, with payment evidence. Link to this answerCan I receive the whole price before discharging charges?

Examine the ownership chain, acceptance and allocation of the estate, taxes, authority and documents required for sale and registration. Being named as an heir in one document is insufficient. Coordinating transactions may be possible depending on the case, but requires preparation with the notary and adviser before committing to a date.

Link to this answerHow can I reduce fraud risk when payment details change?
Verify any change through an established channel with an identified person; do not rely only on a new email. Check the account holder, bank details, contractual instructions and recipient. Coordinate the payment method with the notary and keep evidence. An apparently correct email address does not establish authentic banking instructions.

Who is behind Spain Property Check?
The project is linked to Colás Abogados and Hugo Gutiérrez Colás, a Spanish lawyer registered with ICALI under number 6,539, practising since 2007 with an office in El Albir, Alicante. He works in Spanish, English and Swedish. The website distinguishes information and tools from professional services requiring an engagement, documents and quotation.

Link to this answerDo you advise on property throughout Spain?
Yes: in-person assistance for transactions in the Valencian Community and Murcia, and remote advice throughout Spain with a scope agreed for each property. This does not imply offices in every destination. Where a check needs a site visit, measurement or local intervention, the required professional or action and cost are identified before instruction.

Link to this answerMust my lawyer be based in the same municipality?
The key factors are property-law experience, independence and the ability to obtain and cross-check information about the property and its location. Much documentary analysis can be performed remotely. Legal review must coordinate with technical specialists and local checks where appropriate: remote work does not turn a document review into a physical inspection.

Link to this answerWhat does your due diligence cover?
The engagement systematically examines ownership, authority, charges, registry and cadastral information, planning, buildings, intended use, community matters, occupation, agreements, documents and transaction tax within its scope. Findings are linked to decisions and contractual conditions. Pending checks and additional technical work are identified rather than treating missing information as clearance.

Link to this answerIs the tool's automated report the same as the legal report?
No. The tool helps organise supplied information and documents and provides functions described in its methodology. It does not establish that a lawyer has checked the property. The professional legal report follows an engagement and checks performed by the firm, identifying sources, scope and the limits of that work.

Link to this answerHow do I request a quote and what affects it?
Provide the municipality, property type, transaction stage, intended use, expected date and list of available documents. The firm offers competitively priced advice with a quotation tailored to scope and complexity. The engagement should clarify included work, tax, external costs and additional tasks. A tool's price should not be assumed to cover the entire purchase.

Link to this answerCan I use the contract generator for every property in Spain?
The generator covers resale homes throughout Spain, including the islands, Ceuta and Melilla, between adult individuals acting personally. The questionnaire adapts the agreement to the location and applicable documentation. Special transactions outside the situations covered by the form require individual preparation.

Link to this answerDoes electronic signing replace the notarial purchase deed?
Electronic signing can be used for the private agreement within the offered workflow. It does not turn that agreement into a public deed or replace requirements for the notarial act, financing or registration. Check signatories' identity, authority, document content and email addresses. The private agreement and deed serve different purposes.

Link to this answerHow are these answers maintained, and can I request a specific review?
The library identifies sources and its editorial check date. It is reviewed progressively and when relevant changes are found; it is not real-time monitoring of every municipality. Advice on your property requires current information. Request a file review stating location, intended use and the decisions you need to resolve before committing.
