Start with the official coastal information
For a coastal home, identify the parcel on the official coastal mapping and examine the relevant delimitation information, known as deslinde. MITECO provides information on the maritime-terrestrial public domain and affected private land. Distance from a shoreline drawn on a general map cannot determine the legal position. Save the map reference and date, and ask which administrative decision applies to the property.
Understand the right being sold
Ask whether the transaction concerns ordinary private ownership, land affected by restrictions or rights under a concession. If a concession is involved, request the full document, its conditions, duration and any relevant transfer requirements. Compare that information with the title and contract. Do not let a listing’s use of the word “freehold” replace a review of the actual Spanish documents and the rights they describe.
- Request any coastal authority correspondence held by the seller.
- Identify affected gardens, terraces, access routes and outbuildings.
Ask before planning alterations
A home that can currently be occupied may still face restrictions on future works. Put your intended changes on a plan: enclosing a terrace, extending a pool, rebuilding a wall or changing access. Ask the competent authorities and your adviser which permissions would be needed. Keep municipal planning questions and coastal questions separate so that an answer from one administration is not mistaken for a complete clearance.
Consider the physical setting too
Coastal legal restrictions and coastal hazards are different checks. Review available marine flood information and consider exposure, drainage, salt corrosion and maintenance during storms. Ask the insurer about the actual property and intended occupation pattern. An attractive elevated apartment can still depend on vulnerable basement parking, entrances or communal equipment. Use a technical inspection to identify those practical issues alongside the documentary coastal review.
