Ownership and the right to live in Spain

Buying a home and obtaining permission to live in Spain are different processes. Do not build your relocation plan around the assumption that ownership grants residence or unrestricted stays. Your nationality, immigration status and intended length of stay need their own review. Particular locations or types of property can also require additional checks. Tell your adviser who the buyers are and where the property is before agreeing a completion date.

Organise identification and representation

Plan the NIE application early where it is needed, using the official procedure appropriate to your circumstances. Check the validity of passports and how names appear across banking and purchase documents. If someone will sign for you, have the notary review the proposed power of attorney before it is executed abroad. Ask specifically about legalisation, apostille and translation requirements instead of assuming a foreign document can be used unchanged.

Document funds and financial commitments

An international purchase often involves several banks and currencies. Gather evidence of savings, income, a previous property sale or other sources of funds before the transfer is urgent. Ask the receiving institution which documents it expects and allow time for checks. A mortgage indication is not final approval. If your income and mortgage payments use different currencies, include exchange-rate changes in your affordability planning.

Plan for ownership after the purchase

Tax residence does not follow nationality automatically, and a property can create filing obligations even when it produces no rent. Agree who will handle notices, local taxes, community correspondence and maintenance while you are away. Keep a contact address that you actually monitor. For joint purchases, settle the ownership shares and consider the wider implications for inheritance and family arrangements before the deed is signed.
