Buying property in Andalusia

Andalusia combines major cities, coastline and many rural homes. The legal enquiry differs sharply between an urban flat, a house on rural land and a home advertised for holiday letting. In particular, an older building’s status cannot be resolved from a photograph or cadastral reference alone. A house may appear complete while an outbuilding still has an unresolved planning status. It helps to separate what the Land Register records, what Cadastre describes and what actually stands on the plot. Buying a main home also calls for different decisions from buying for holiday guests; decide which use matters before signing a deposit contract.

Purchase taxes: start with the right scenario

Before budgeting, distinguish a resale home —normally subject to transfer tax— from a developer's first transfer, which in VAT territory must be assessed for VAT and, where relevant, stamp duty. A business seller or special transaction can require different treatment.

For the map's limited example —a €300,000 resale home, tax base equal to price, adult buyer without reliefs and the 2026 rules consulted— indicative transfer tax is €21,000. This is not a universal property-tax rate.

Andalusian standard rate in this example; lower rates have separate conditions.

Calculate Andalusian ITP or AJD by transaction type and eligibility for reduced rates; check the regional law in force when the tax arises. The actual filing depends on the facts and rules in force when tax arises.

For transfer tax, check the cadastral reference value: a higher price or declared value may determine the tax base. The map example expressly assumes price and tax base are equal. Budget separately for notary, registration, financing and later ownership costs.

What to check in this region

Territorial check

For homes with unrecorded additions or irregular buildings, obtain the municipal AFO decision and read its limits: recognition does not legalise the work.

Use and permissions

If tourist letting is planned, verify the Andalusian declaration and registration and the municipality's actual planning restrictions.

Building inventory

Compare title and Cadastre with a survey of the house, pool and outbuildings. Ask for the permission or municipal decision explaining each element, without presenting any AFO as legalisation.

Request a current Land Registry extract, cadastral reference, deed and building-work history; for flats add the owners' association certificate and minutes. The municipality should confirm planning and uses where they affect the purchase. A plan, registration or photograph alone does not establish planning legality.

Areas and local decisions

A region is neither a single market nor a single planning regime. These areas raise different questions; the answer depends on the plot, building, municipality and intended use.

Málaga and eastern Costa del Sol

In Málaga city, distinguish residential and tourist use by location and building regime. In Rincón de la Victoria and Torre del Mar, add coastal-public-domain and drainage checks. For off-plan purchases, examine permission, advance-payment guarantees and delivery arrangements.

Marbella, Benahavís and Estepona

For villas and residential developments, reconcile permissions and extensions with the actual buildings; investigate conservation entities, charges and municipal adoption. Proximity to golf or the sea does not establish development or tourist-letting rights. Check plots, annexes and communal services separately.

Fuengirola, Mijas and Benalmádena

Distinguish coastal apartments from inland Mijas houses: access, drainage and land classification can change the assessment. In shared-service buildings, review bylaws, major works, accessibility and operating restrictions. Check the documentary position of enclosed terraces and internal alterations.

Nerja and Frigiliana

In historic centres, check heritage protection and permitted façade or roof works. For rural Axarquía homes, identify land classification, access and water supply. Administrative recognition of an existing building should not be mistaken for permission to extend it or change its use.

Cádiz, Conil and Chiclana

Historic Cádiz homes raise conservation and community questions; coastal houses and the Chiclana area can call for closer examination of land status, services and subdivision. Obtain property-specific documents and coastal checks where relevant. A postal address does not establish lawful planning subdivision.

Tarifa and Sotogrande

Distinguish an urban apartment, a rural coastal property and a serviced-development home. Check protected areas, coastal rules and title to any advertised access or mooring. In Sotogrande, identify conservation charges and service obligations attached to ownership.

Almería, Mojácar and Roquetas de Mar

In holiday developments, confirm whether you are buying a home, tourist unit or another permitted use and examine operating agreements. For inland houses, check water, access and planning. Near Cabo de Gata, consult parcel-specific protection boundaries rather than generalising across the province.

Granada and Costa Tropical

In the Albaicín and other protected areas, consult heritage listings and rehabilitation conditions. In Almuñécar and Salobreña, combine coastal checks with access, slopes and retaining works where present. Unusual accommodation, including cave homes, needs use, habitability and property-specific technical documentation checks.

Sevilla and Córdoba

For historic buildings and courtyard houses, investigate protection, earlier alterations and shared elements. Before budgeting refurbishment or tourist letting, obtain municipal information about both. If occupied by tenants, review agreements and whether possession can be delivered on the agreed date.

Huelva, Isla Cristina e Isla Canela

For apartments and developments on Huelva's coast, review community matters, maintenance and facility rights. Near marshes, estuaries or protected areas, consult parcel-specific boundaries and constraints. Distinguish residential and tourist operation before reserving and obtain annex and parking documentation.

If you plan to live here

If you are settling in Andalusia, decide whether you need a main home in a city, a coastal development or a rural house: access, utilities and authorised use require different checks. In the countryside, ask about the planning status of every building and the scope of any AFO decision before treating it as a home. If holiday letting is also planned, assess that use separately. Once you choose a municipality, plan municipal registration and the residence route that applies to you; a purchase does not grant a permit. Keep records of time spent in Spain and economic ties to assess tax residence under domestic rules and any applicable treaty.

Owning a Spanish home does not itself grant a right of residence or determine tax residence. If you move to Spain, coordinate immigration documents, local registration where applicable, healthcare cover and tax timing with your personal circumstances. Check utilities, actual vacant possession and key handover before planning the move.

If you are an EU citizen staying longer than three months, check the applicable registration requirement; if you are not an EU citizen, identify the appropriate stay or residence route in advance. Municipal registration, an NIE, home ownership and tax residence are distinct matters. Budget for local property tax, owners' association charges, insurance, utilities and possible non-resident income tax while you remain a non-resident.

Hypothetical example

Example: an overseas couple reserves an Andalusian country house with a pool and separate studio. The advert adds all floor areas, but the title extract describes only the main house. Before paying a deposit, they request building permissions, plans and any municipal AFO decision for each structure; AFO does not equal legalisation. A technical visitor measures the actual works. If the studio cannot lawfully function as a home or holiday let, they renegotiate the price and document who will deal with outstanding steps.

The example frames useful questions; it does not describe a real property or replace municipal enquiries or a technical inspection.
