First identify what is being transferred
For ordinary residential transactions in the Spanish VAT territory, a first supply of a completed home by a developer generally follows the VAT route, while a typical purchase from a private owner follows transfer tax. The legal classification is more precise than the listing labels 'new' and 'second-hand'. Previous occupation, refurbishment and the seller's circumstances can matter. Ask for the transaction to be classified before relying on a budget.
Locate the competent tax authority
Spain does not have one universal property purchase percentage. Regional rules affect transfer tax and stamp duty, including reduced rates and eligibility conditions. The Canary Islands have a different indirect-tax system, and Ceuta, Melilla and the foral territories require attention to their own framework. Use guidance for the property's actual location and the date of the taxable event. Do not transplant a calculator result from another autonomous community.
Check the base as well as the rate
A correct percentage applied to the wrong base still produces the wrong estimate. For property transactions within the common transfer-tax regime, the statutory reference-value rules must be considered, including circumstances in which a higher declared value or agreed price prevails. Ask about separately identified garages, furniture or other elements instead of allocating amounts informally. Any relief should be supported by evidence that the buyer and property meet its conditions.
Plan filing and special seller situations
Obtain a written calculation identifying the taxpayer, authority, form, due date and person responsible for filing. Ask separately whether the seller's tax residence creates a withholding obligation for the buyer, and whether local tax issues need attention. These are different questions from the buyer's acquisition tax. Keep payment and submission receipts, and check that any later correction to the transaction is reflected in the relevant advice and filings.
